Single Expert Witness
AVS (Northwest) are specialists in providing independent and impartial valuations in the Pilbara for Family Law Court purposes.
In the case of family law a Single Expert Witness is appointed and instructed jointly by both parties. Rules in the Federal Circuit and Family Court (FCFCA) require that evidence about the value of a property be given by a 'Single Expert Witness' which are detailed below.
What is involved in a family law valuation?
A physical property inspection will be undertaken by the valuer with photo's and measurements taken.
A detailed valuation report will be provided comprising descriptions, sales evidence and photos of the property and detailed analysis. This document is legally binding by both parties.
Family Court Rules 2021 - Part 15 Division 5
An expert’s report must —
(a) state the reasons for the expert witness’s conclusions;
and
(b) include a statement about the methodology used in the production of the report; and
(c) include the following in support of the expert witness’s conclusions —
(i) the expert witness’s qualifications;
(ii) the literature or other material used in making the report;
(iii) the relevant facts, matters and assumptions on which the opinions in the report are based;
(iv) a statement about the facts in the report that are within the expert witness’s knowledge;
(v) details about any tests, experiments, examinations or investigations relied on by the expert witness and, if they were carried out by another person, details of that person’s qualifications and experience;
(vi) if there is a range of opinion on the matters dealt with in the report, a summary of the range of
opinion and the basis for the expert witness’s opinion;
(vii) a summary of the conclusions reached;
(viii) if necessary, a disclosure that —
(I) a particular question or issue falls outside the expert witness’s expertise; or
(II) the report may be incomplete or inaccurate without some qualification and the details of any qualification; or
(III) the expert witness’s opinion is not a concluded opinion because further research or data is required or because of any other reason.
We are an accepted Valuation Firm by the Hedland Maritime Initiative (HMI) to undertake retrospective valuations in the West End of Port Hedland as at 6 August 2019.
Our fee is paid for by HMI and we have successfully undertaken over 50 valuations under the Scheme.

The process includes;
Each lot is given a unit entitlement which is shown on the strata plan. The amount of the unit entitlement varies depending on a number of factors such as the size of the lot. Unit entitlements regulate what proportion of the total annual budgeted levies will be paid by each lot owner.
'Replacement Value' is reflective of a building with the same functional use and useable area as that of the subject property, yet built to a contemporary standard conforming to current bylaws and regulations which may have been adopted since the construction of the subject building.

Transient Worker Accommodation (TWA) in the Pilbara is accommodation used by workers whose principal place of residence is elsewhere; these workers fly or drive to the Pilbara for a period of time to work before returning home. Accommodation used in the Pilbara for this purpose includes purpose built camps, hotels, motels, caravan parks and residential houses. The majority of TWA accommodation in the Pilbara is constructed through use of ‘transportable’ or ‘donga’ style facilities. This form of accommodation is prefabricated and transported into the Pilbara on trucks where it is connected to utility infrastructure.

A State Development Agreement (not to be confused with a legislated ‘State Agreement’) was signed on 9 September 2011, which outlines the services required by Onslow as a result of the impact of the Wheatstone project. It also sets out the financial contribution to be provided for these projects.
